Service Terms and Conditions

Fixed Price Work

The estimate is valid for 45 days from the date of the written quote. Prices may need to be reviewed after this period to reflect any changes in material or fuel costs. You shall give timely notice of when work is to be carried out.

This quotation allows for the works listed within this quotation only. We must be notified of any discrepancies between the client’s scope and the works listed within this quotation and the costings will be reviewed and amended accordingly. Elite Drainage Services UK Ltd reserves the right to at all times to withdraw any/all quotation(s) if the market conditions change to cause the quotation pricing to become unviable — such as change in material costs, plant hire cost, availability of materials etc. Parking arrangements must be arranged by the customer. Should our engineers receive a parking ticket whilst undertaking works, this will be added to the final invoice.

Invoices and Payment

Upon agreement for us to carry out any estimated or Prebooked work, a deposit of 50% of the total is payable immediately. We reserve the right to request full payment in advance at our discretion. Upon completion of work, you will be invoiced, for which payment is due on receipt, unless otherwise agreed. Elite Drainage Services UK Ltd reserves the right to accrue and charge interest on any balance that remains unpaid beyond the due date at a weekly interest rate of 5% which continues to accrue until payment is received in full. You accept sole liability to make payment in full, unless you disclose when initially instructing us, to carry out work and/or supply materials that you are acting on behalf of a third party. If you are instructing the works on behalf of a third party, we must be informed, and invoicing details of the payee must be supplied to us a minimum of 1 week prior to commencement of works. If this is not disclosed, any costs incurred will be the responsibility of the individual instructing the works. In the event of non-payment by the customer within the specified payment terms, Elite Drainage Services UK Ltd reserves the right to engage the services of a debt collection agency to recover the outstanding amount. The customer acknowledges and agrees that any costs incurred by the Elite Drainage Services UK Ltd in the recovery process, including but not limited to debt collection agency fees and legal expenses, shall be the sole responsibility of the customer. Failure to address the outstanding debt may result in the Elite Drainage Services UK Ltd pursuing a County Court Judgment (CCJ) against the customer. A CCJ may impact the customer’s credit rating and may have legal consequences.

Cancellation

Elite Drainage Services UK Ltd will always assume unrestricted access and that we may progress uninterrupted by any other works that may be taking place on the premises. Should we arrive on site and our works must be aborted due to circumstances out of our control there will be an abortion fee of a minimum of 80% of the total job value plus VAT.

Guarantee
A 10-year guarantee is provided on all Elite Drainage Services UK Ltd foul system remedial works. This will be received upon full payment of the works. Elite Drainage Services UK Ltd guarantee extends the cover of the works carried out by Elite Drainage Services UK Ltd for a period of 10 years, with effect from the date of completion, this covers the property for any failure of efficiency in the works carried out only by Elite Drainage Services UK Ltd within the area of works.
Sub-Contracting

Elite Drainage Services UK Ltd may sub-contract the provision of any or all of our services. Elite Drainage Services UK Ltd ensure that any and all sub-contractors are reasonably skilled in the relevant practices.

Second Man Labour Surcharge

Supplementary fees for the enlistment of a second skilled laborer may be incurred at the engineer’s discretion, deemed essential for the optimal support of the drainage engineer during the course of the job.

Additional Terms

Quotations for high pressure jetting works allows for the use of our mobile pressure jetting units which are fitted within our company vehicles. The jetting units fitted on vehicles operate at 8 gallons per minute at 3000 psi. Should a tanking unit be required, additional charges will apply. Our high-pressure jetting vehicles carry 60 metres of jetting hose unless otherwise stated. Should extra jetting hose be required there may be an additional charge. This quotation allows for the use of battery powered push rod system only. Push rod system is capable of surveying pipework with a diameter ranging between 100mm-300mm. Should there be pipework on site with a larger diameter than 300mm we must be informed or provided drawings with pipe diameter noted when the initial quotation request is made. In this quotation Elite Drainage Services UK Ltd have assumed access to a strong water supply within 30 metres of all working areas for our usage at no cost. This does not include fire hydrants unless a license is provided. Elite Drainage Services UK Ltd always assume unrestricted access to this water supply when on site. Elite Drainage Services UK Ltd classify accessible drainage as a drainage point which can be accessed without the need for the following: disturbing the ground, cutting back vegetation, cleaning works to the pipework to permit the CCTV camera to access/progress down the pipe, moving items/vehicles from the area, cutting pipework, removal of panelling/walls, potentially damaging seals on a rodding access, damaging a manhole cover/gully grate to access the chamber, use of access platforms, traffic management procedures, additional jetting hose, use of a Porta Reel and use of confined space entry equipment. Welfare facilities must be available on site for employees of Elite Drainage Services UK Ltd to use.

Additional Terms applicable to CCTV Surveys

If manholes are not accessible on arrival, these manholes will not be surveyed. Any quotation for a CCTV Survey has been compiled using available information and as accurately as possible. However, if due to some unforeseen adverse changes in ground and/or site conditions there is extra expenditure involved, it will be chargeable. The report from CCTV Survey will be available 5-7 business days after the CCTV Survey has been completed and the payment has been made. Elite Drainage Services UK Ltd are unable to release any paperwork from a CCTV Survey until the payment has been received, unless otherwise stated. If for any reason when Elite Drainage Services UK Ltd arrive on-site, we need to create an access point to the manhole by means of excavation after approval with You, we are not liable for any damage caused. We will however provide a quotation to reinstate to the original order. The CCTV Survey report and any other information will only be supplied to you and not to a third party and is for your sole use. Where Elite Drainage Services UK Ltd have been commissioned to carry out an inspection of the accessible areas of the drainage to the property, identifying any major defects and recommending any repair works that may be necessary. It should be appreciated that the exact layout of the system cannot be confirmed without the exposure of inaccessible branches and connections etc. The lack of any significant defects in the CCTV Survey Report within the main drainage line should not be regarded as a guarantee of water tightness. Defects may be encountered upon exposure to inaccessible branches and gullies etc. The contents of the CCTV Survey report are strictly confined to comments concerning those terms outlined in the report. It is not a structural survey and must not be construed as such. The views expressed in the CCTV Survey report are based entirely upon a visual examination of the drainage, supported by information obtained from a drainage CCTV inspection. Should a section of a CCTV Survey be abandoned due to reasons out of Elite Drainage Services UK Ltd control, the diagnostic will be provided to the client. However, this service will still be chargeable and qualify as a successful CCTV Survey.

Force Majeure
Neither party shall be liable for any failure or delay in performing their obligations where such failure or delay results from any cause that is beyond the reasonable control of that party. Such causes include, but are not limited to: power failure, internet service provider failure, industrial action, civil unrest, and fire. Flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of the party in question. In that case, the failure or delay will not be a failure or delay contrary to these Terms or other terms of the contract.
